1. Definitions
- “KUTH,” “we,” “us” = Keep Up The Hope (KUTH) Foundation
- “User,” “you” = any person accessing
- “Services” = all programs, content, donation processing, volunteer coordination
- “Content” = all materials on the website
2. Use of the Website
Permitted:
- Learn about programs
- Make donations
- Apply to volunteer
- Submit inquiries
- Access public reports
Prohibited:
- Unlawful purposes
- Unauthorized access
- Interference with website operations
- Scraping without permission
- Submitting false information
- Distributing malware
- Impersonation
- Commercial use of beneficiary data
Violation may result in termination and legal action.
3. Donations
All donations are voluntary, irrevocable gifts. Not investments, loans, or purchases. No financial return offered.
- Currency: Nigerian Naira (₦)
- Methods: Bank transfer, debit/credit card (Paystack/Flutterwave), mobile money, USSD
- Recurring donations: Cancel anytime via donor portal or email giving@kuth-ng.org
- Tax deductibility: Consult FIRS for Nigerian donors; consult local advisors for international donors. Receipts issued for all donations.
- Refund policy: Generally non-refundable. Exceptional requests (duplicate charges, errors) within 14 days to giving@kuth-ng.org. Approved refunds within 14 business days.
- Fund allocation: 80%+ to program delivery. Annual financial reports published.
4. Intellectual Property
All content is exclusive property of KUTH Foundation or licensed. KUTH name, logo, “Hope in Action” are registered trademarks.
Limited license:
- View, download, print for personal non-commercial use
- Share links
- Use public materials for educational/advocacy with attribution
You may not:
- Reproduce, modify, distribute without permission
- Use trademarks commercially
- Remove copyright notices
- Use beneficiary images without consent
User-generated content: Submitting testimonials or applications grants KUTH a non-exclusive, royalty-free, perpetual license for organizational purposes.
5. Beneficiary and Volunteer Applications
Subject to eligibility verification, availability, program rules, and documentation. No guarantee of admission. KUTH reserves right to decline.
Volunteers agree to background checks, Code of Conduct, Child Protection Policy, confidentiality, and immediate welfare reporting.
6. Legal Aid Program (LAPI) Specific Terms
- Attorney-client relationship established only upon signed engagement, not through website inquiries.
- Scope: Pro bono criminal defense, civil rights advocacy, post-release documentation. No guaranteed outcomes.
- All legal aid communications confidential per law and professional ethics.
7. Third-Party Links
Not responsible for content, privacy, or security of third-party sites.
8. Disclaimers
“As is” and “as available.” No warranties of uninterrupted access, error-free operation, or virus-free environment.
Limitation of liability: Not liable for indirect, incidental, special, consequential, or punitive damages under Nigerian law.
Force majeure: Not liable for failures beyond reasonable control.
9. Indemnification
You agree to indemnify KUTH from claims arising from your violation of these Terms or use of the website.
10. Governing Law and Dispute Resolution
Governed by laws of the Federal Republic of Nigeria.
Disputes: Good-faith negotiation first (30 days). Then mediation under Lagos Multi-Door Courthouse rules. Then Lagos State High Court.
11. Modifications
Material changes posted with updated Effective Date. Continued use constitutes acceptance.
